Creditors Harass Debtor on Social Networking Site
When Melanie Beacham fell behind on her car payments, her auto loan account was sent to a collections company. This happens to thousands of people every year who are unable to make payments; however, Beacham's story differs in that the collections company started to harass her on Facebook.
Even though Beacham had already discussed a payment plan with her creditor regarding the late payments, MarkOne Financial started to contact her regarding debt collection. It was when they started to send messages to her friends and family on Facebook that Beacham became first worried, then angry about the ordeal. In these messages, MarkOne implored her friends to ask Beacham to contact them immediately about her late payments.
Beacham now has an attorney and a lawsuit filed against MarkOne Financial in which she cites multiple violations of both federal and state (Florida) law. While the lawsuit itself is still pending, a judge ordered MarkOne to cease contacting Beacham's friends and family via Facebook and any other social networking site.
