Stopping Creditor Abuse
Are you in serious credit card debt? If so, you are likely to be receiving daily phone calls from creditors and debt collection companies. Believe it or not, you do have rights as a debtor, rights that are enforced by the Federal Trade Commission.
In order to protect you, the debtor, from unruly debt collectors, you have rights under the "Fair Debt Collection Practices Act." If any creditors are going above and beyond to make your life miserable, threatening you over the phone, using abusive language or calling late at night or early in the morning, you can actually file suit against them.
Rather than deal with debt collection agencies, try to talk directly with your original creditor. You may be able to work out a deal with the creditor that fits your financial abilities, rather than pay a third party more than you need to. However, you will want to speak with the original creditor before the account is sold to a debt collections agency in order to make a deal.
