What to do When Creditors Harass You
One of the reasons people finally decide to file for bankruptcy is to avoid the constant phone calls and mailers from creditors. When you file for bankruptcy, you are given an "automatic stay" by a bankruptcy judge. This means that during the process of bankruptcy, creditors are not allowed to contact you to collect on debt that is owed. However, even after you have successfully filed for Chapter 7 or
Chapter 13, you may continue to experience
creditor harassment.
While a creditor is allowed to contact your bankruptcy attorney, at no point are they supposed to continue contacting you regarding your debts. If you have recently filed for bankruptcy but have a creditor that continues to call, you have the legal right to report that person or company. Should the harassment continue, tell your bankruptcy attorney about the calls so they can take immediate action to correct the problem.
